LEARNING OBJECTIVES
Participants will obtain brief background knowledge of the history of disability access laws in the US and California; become familiar with basic disability access terminology; understand legislation related to CASp programs and services as well as the programs’ objectives and general requirements; and recognize areas and elements where disability access is lacking and/or frequently litigated and be better equipped to advise clients.
Participants will be able to identify applicable accessibility standards for new construction or alterations projects at privately funded public accommodations and commercial facilities; understand organization and contents of the standards; correctly perform research to identify both scoping and technical requirements applicable to specific elements; and understand when to refer to different sets of regulations and or standards.
Participants will understand what to do when there are conflicting accessibility requirements in various standards on the same element; understand the need to provide design dimensions that allow tolerances for construction activities; identify and incorporate critical dimensions and notes to specify in construction documents; and understand what to do when full compliance is not possible.
Participants will be able to recognize which property types are governed by the Americans with Disabilities Act (ADA), which are governed by the Federal Fair Housing Amendments Act (FHA), and when they are governed by both. The participant will be aware of other regulations and codes that may also apply and what questions to ask in the pre-design phase. Participants will also become familiar with the ten safe harbors under the FHA and what to consider in selecting a safe harbor for the design; and understand how to apply requirements based on dates of construction and/or alteration when altering or adding to an existing building.
Participants will understand the origin and impact of the federal civil rights laws on multifamily residential buildings constructed under the requirements of the FHA; be able to identify the prevailing FHA & ADA requirements when they conflict with each other and with other federal regulations; be able to identify critical elements and data to include on construction drawings and best practices for dimensioning drawings to achieve compliance; and recognize common errors and develop best practices for avoiding them.
