The Anatomy of a Design Contract: Guidance on Scope of Service Essentials and More

CES Learning Units: 1.5 LU

The event will feature presentations by industry counsels on the key parts of design contracts, including scopes of service, compensation, schedule, and other important terms such as , standard of care, indemnification, ownership of documents and more. The presentations will provide an overview of provisions to include, as well as those to avoid, in contracts. After the presentations, the audience will be provided an opportunity to participate in a Q&A with the counsels.

Presenters:

Mark Harmon –  Contracts Director, LPA
Mark since 2015 has been reviewing and negotiating contracts as the Contracts Director, at LPA, Inc., an Irvine, CA based multi-discipline firm with that has been the recipient of many AIA awards since its start in 1965. Prior to LPA, Mark was a contracts director at AECOM during his 2001 to 2015 tenure with the firm.

Evan Grant – Senior Counsel, AECOM
Evan is a Senior Counsel in AECOM’s Legal Department. He focuses on the drafting, review, and negotiation of professional services agreements, primarily relating to design-build pursuits. He’s been with AECOM since 2016 and previously worked in-house for a design-builder and another large professional services firm.

 

Mehrdad Farivar, FAIA –  Senior Counsel, Clark Hill
Mehrdad Farivar FAIA, Esq. is a California licensed architect and practicing attorney with the Los Angeles and San Francisco offices of Clark Hill LLP. He specializes in the representation of design professionals and real estate and land use matters”.

 

Eugene Tucker – Associate General Counsel, HOK
Eugene Tucker is an Associate General Counsel at HOK, where he concentrates on P3 and Design Build projects. Prior to HOK, Eugene worked as a construction law litigator for six years.

Learning Objectives:
+ Participants will understand the main components of a design contract.
+ Participants will understand key provisions within these components.
+ Participants will understand how these provisions can positively or adversely impact a contract.
+ Participants will understand how to make your case when discussing contract terms with clients.
